If a woman and her husband give permission to a doctor to abort her fetus, and if we accept that diyya (blood money) needs to be paid by the doctor (or by the mother, if she was the one who performed the abortion), can the father of the aborted baby relieve the mother and her doctor from having to pay the diyya?

Diyya (blood money or compensation for a tort) is imposed on the person who actually performs the abortion, which is the doctor. The parents may relieve the doctor. Their simply agreeing to the abortion does not eliminate their right to diyya.

امراة برضاها ورضا زوجها اسقط الطبیب جنینها، فاذا قلنا ان الدیة علی الطبیب او الزوجة اذا كان بفعلها فهل للاب اسقاط الدیة عنهما؟ خاصة وانه راض بالفعل او كان بامره او یحرم منها الاب وتكون لغیره من الورثة؟ تثبت الدیة علی المباشر للاسقاط وهي الطبیبة وللابوین اسقاطها عنها فان مجرد رضاهما بالاسقاط لایوجب سقوط حقهما في الدیة.
