Question 1: If [obeying] the Guardian of Faqih is a matter of emulation or research and individual satisfaction?
Fatwa: A matter of emulation.
Question 2: What is your excellency's view of the guardianship of faqih?
Fatwa: Guardianship in personal matters [such as the rulings on marriage, divorce, death, inheritance, etc.]exists for any faqih who has the necessary qualifications [such as being a male faqih who believes in the Shiite Imams and abstains from committing the greater sins]. However, in other aspects of the social life, upon which the order of the Islamic society depends, there are other qualifications that are imperative both in the Guardian Faqih himself as well as in implementing such guardianship authority. For example, there must be a common acceptance of such guardianship from the general community of believers.
Question 3: Please advise if a ruling from an Ayatollah differs from that of the Guardian Faqih, to whom shall we refer?
Fatwa: The rulings of a person who has due guardianship must be abide by in such matters upon which the order of the society and the lives of people depend. Even other Ayatollahs and faqihs must abide by such rulings from the qualified Guardian Faqih, unless they know for certain that such ruling is inconsistent with the Quran or the Prophet's Sunnah.
حضرت آیت الله العظمی سیستانی به سه استفتاء درباره بحث ولایت فقیه پاسخ داده اند.
به گزارش «تابناک»، این پرسش و پاسخ که در سایت شخصی معظم له منتشر شده، به شرح زیر است:
پرسش: آیا ولایت فقیه تحقیقی است یا تقلیدی؟
پاسخ: تقلیدی است.
پرسش: نظر معظم له درباره ولایت فقیه چیست؟
پاسخ: ولایت در آن چه ـ به اصطلاح فقها ـ امور حسبیه خوانده میشود برای هر فقیهی که جامع شرایط تقلید باشد ثابت است و اما در امور عامه که نظم جامعه اسلامی بر آنها متوقف است، هم در شخص فقیه و هم در شرایط به کار بستن ولایت امور دیگری معتبر است، از جمله مقبول بودن نزد عامه مؤمنین.
پرسش: میخواستم بدانم اگر حکم مرجع تقلیدی با حکم ولی فقیه فرق داشت، مقلد باید از کدام اطاعت کند؟
پاسخ: حکم کسی ولایت شرعی دارد، در امور عامّه [که] نظام جامعه و معاش مردم بر آن مبتنی است بر همه نافذ است حتی بر مجتهدین دیگر، مگر اینکه علم به خطا بودن آن یا مخالفتش با آنچه از کتاب و سنت قطعاً ثابت شده داشته باشد.
گفتنی است، از جمله مواردی که همواره مخالفان بحث ولایت فقیه، به کمک آن، سعی در متقن نشان دادن شبهات خود دارند، این بوده است که بحث ولایت فقیه و برداشت حضرت امام خمینی(ره) در این باره، برداشتی شاذ و نادر بوده و بیشتر! مراجع متقدم و متأخر چنین برداشتی از متن شرع نداشته اند.
