Fatwa Question or Essay Title:
Ayatollah Dastgheyb condemns the brutality on the day of Ashura in Iran in 2009 and argues that clerics must break silence:

Ayatollah Dastgheyb, a member of Iranian Assembly of Experts which is empowered to elect and impeach the Supreme Leader, has extended condolences on martyrdom of presidential candidate Mir-Hossein Moussavi's nephew and other martyrs of the day of Ashura in Iran, and has requested justice for the murderers.

It is reported that the nephew of Mr. Moussavi and several others are martyred during the clashes on the day of Ashura.

Firstly, I would like to extend my condolences to Mr. Moussavi, the Prophet Mohammad, and the families of the martyrs.

Secondly, I would like to request the authorities to find the murderers and bring them to justice.

Thirdly, I would like to recommend to the authorities to respect the legitimate and rationale demands of the Muslim nation of Iran and refer them to the rulings of the Quran, the Prophet's tradition, and the Constitution, and stop all these wrongful acts that are being done in the pretext of safeguarding the Regime.

Fourthly, I would like to ask the Ayatollahs and the clerics to break this silence, speak out, and demand the regime to comply with the Constitution, may the Islamic revolution be liberated from the hands of radicals.
