Islam and the Constitution

The forms and strictures of the original 1959 constitution continue to impact the drafting of the new constitution, especially in the area of state-Islam relations.  Areas of special importance include the place of Islam in national identity and as a requirement for presidential candidacy, as well as the relationship between shari’a and national legislation.  However, besides these hot-button topics, Islam has been increasingly institutionalized in Tunisia throughout the changes of regime.
